Do existing listings published in the MLS need the MLSA form?
No.
What Property Type/Categories does this form apply to?
All.
Is CRMLS following NAR guidance?
Yes and No
NAR creates policies and CRMLS makes rules from their policies, therefore CRMLS interprets the policies in a way that’s the most relevant to our purposes.
Paragraph 3
Can I publicly market a listing NOT in the MLS?
To engage in public marketing, a listing must be in the MLS within one (1) business day of marketing a property to the public; the listing broker must submit the listing to the MLS for cooperation with other MLS participants. Marketing within the brokerage is private, outside of the brokerage is public.
If you don’t put it in the MLS, you cannot publicly market the listing outside of your brokerage.
What option do I select on the form if I want to market it off-MLS?
- Open or Non-Exclusive Listing
- CRMLS rules permit full public marketing of an off-MLS listing if a non-exclusive listing agreement is signed.
- Agent should consult their Broker
- Any public marketing of a listing with an Exclusive Listing Agreement will violate the CRMLS CCP rule.
Paragraph 4
Internet: No = Total Internet Opt Out.
Completely opting out of sharing on the listing on the internet means no IDX, VOW, syndication to Zillow, Realtor.com, and other similar sites. Also, the listing agent cannot put it on their website, social media sites, emails, flyers, or any mobile display. The listing will still appear in our MLS systems (Flexmls, Matrix, Paragon, Paragon Connect, Perchwell) and those MLS systems’ client collaboration portals, such as Onehome, Collaboration Center, and Flex Portal.
Paragraph 5B
Delayed marketing limited exposure
CRMLS does not have this option.
About 80% of USA MLSs do not have a delayed marketing option.
Seller Instructions to Broker Page 2B
Do I need my seller to select 2B?
No, because that is not an option for CRMLS users.
Does selecting “Office Exclusive Limited Exposure” (Marketing Option 2D on Page 3) mean the listing must be input as Registered?
Yes, if a listing agent opts for 2D and has an Exclusive Listing Agreement, the agent must enter the listing as Registered
